Duties

  • You will provide legal representation to Department of the Navy, Exceptional Family Member Program, Sailors, and their families seeking special educational and disability benefits from federal and state resources for the exceptional family member.
  • You will advocate for the rights of EFMs under the federal Individuals with Disabilities Education Act and other state and federal education laws pertaining to persons with disabilities and their rights to a free and appropriate public education.
  • You will assist families in meeting the educational needs of their children by meeting with clients, reviewing and evaluating their individual cases and counselling families on action plans to best secure educational benefits and support.
  • You will be required to research, interpret, analyze disability laws, and complex state and federal statutes, manage a substantial caseload, and write legal memoranda and briefs.
  • You will advocate procedural issues under federal disability laws and regulations, including but not limited to the Individuals with Disabilities Education Act, Family Educational Reporting Practices Act and state education policies and procedures.

  • You will be required to obtain and maintain an interim and/or final security clearance prior to entrance on duty. Failure to obtain and maintain the required level of clearance may result in the withdrawal of a job offer or removal.
  • This position may require travel from normal duty station to surrounding schools. CONUS and OCONUS and may include remote or isolated sites. You must be able to travel on military and commercial aircraft for extended periods of time.

Qualifications

The successful candidate resume must demonstrate:
  • Must be an active member in good standing of the bar of the state in the location being advertised, admitted to practice before the highest court in the state of the location being advertised, and shall be admitted to practice before the United States District Court within
    (3) months of hiring.
  • The Virginia applicant must be a member in good standing of the bar of the Commonwealth of Virginia and admitted to practice before the highest court in the Commonwealth of Virginia and shall be admitted to practice before the United States District Court, Eastern District of Virginia within three (3) months of hiring.
  • The applicant shall possess at least one (1) year of demonstrated litigation experience in Disability laws, including the Americans with Disabilities Act (ADA), the Individuals with Disabilities Education Act (IDEA), and the Rehabilitation Act of 1973, which includes sections
    504 and 508. Incumbent should have a strong interest to practice education law with an emphasis on special education. An incumbent with experience practicing before administrative bodies is highly desirable.
  • The applicant must have a minimum of one year of post-law-school legal litigation experience in the practice of IDEA or ADA and must have a familiarity with the DON.
  • Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., professional, philanthropic, religious, spiritual, community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment.

    Education

    The successful applicant must have graduated with a J.D. or LL.M. from a law school accredited by the American Bar Association, be an active member in good standing of the bar of the highest court of a State, U.S. Commonwealth, U.S. territory, or the District of Columbia, and be admitted to practice before a state or federal court.
